Not Covering Birth Control Costs May Violate State Law

The Michigan Civil Rights Commission is expected to rule whether employers with less than 15 employees and who offer prescription care are violating state law if they do not cover prescription birth control such as Ortho Evra® or the pill.

Michigan law currently requires employers with more than 15 employees to provide coverage for the Ortho Evra® birth control patch, the birth control pill, and all other types of prescription contraceptives.

The civil rights commission has had no direct complaints about denial of coverage for birth control, such as Ortho Evra®, but will put violations on record in case they receive future complaints.
