Ortho Evra® Lawsuit Filed in St. Louis for Death of 17 Year Old

On December 16, 2005 Ms. Bintha Lewis, the guardian of the deceased Ashley Lewis, filed a lawsuit against Ortho McNeil Pharmaceuticals, Johnson & Johnson, and various St. Louis City doctors in regard to the death of Ashley Lewis as a result of using the Ortho Evra® birth control patch. The suit was brought in St. Louis City Circuit Court.

Ortho Evra® was prescribed from August of 2003 until Ashley's death. From October 2003, Ashley made multiple visits to doctor's offices, clinics, and Forrest Park Hospital exhibiting signs and symptoms of adverse reactions to the patch until her death on December 17, 2003.

Plaintiff alleges that Ortho McNeil Pharmaceuticals and Johnson & Johnson were negligent in the design, manufacture, and marketing of Ortho Evra® that was not reasonably safe and/or failed to adequately warn about the increase risk of thromboembolitic events. The suit also alleges that the companies were liable as they sold a product that was unreasonably dangerous when put to a reasonable use.

The Ortho Evra® lawsuit alleges that the companies committed fraud do to the fact that they knew that the patch had a dramatic increase in thromboembolitic events compared to birth control pills, yet the companies hid the information from healthcare providers and physicians.

Plaintiff also alleges negligence against the doctors who treated her and Tenet HealthSystems for failure to remove Ashley from the Ortho Evra® patch and failure to properly diagnose and treat her. Damages sought include pain and suffering, funeral expenses, economic loss, and loss of companionship.
