An Ortho Evra® mass action lawsuit on behalf of 55 women and an Ortho Evra® wrongful death lawsuit involving a 26-year-old woman were recently filed in California State Court. The women allege that the Ortho Evra® birth control patch causes blood clots, stroke, and even death.

The two birth control patch lawsuits were filed against Ortho Evra®'s developer and manufacturer, Ortho-McNeil (Johnson & Johnson), and the drug's distributor, McKesson Corporation.

The Ortho Evra® patch wrongful death lawsuit was filed by the mother of a 26-year-old Tennessee woman who died from blood clots and a pulmonary embolism in June of 2003. The woman was prescribed Ortho Evra® in April 2003.

The Ortho Evra® mass action and wrongful death lawsuits charge that Ortho-McNeil knowingly deceived the public about the birth control patch health risks, which include blood clots, pulmonary embolisms, deep vein thrombosis, stroke, heart attacks, and death. The lawsuits argue that Ortho-McNeil and Johnson & Johnson failed to properly investigate Ortho Evra®'s safety and knew of the harmful side effects while continuing to market and sell the patch without accurate warnings.

In November of 2005 the Food and Drug Administration (FDA) required the Ortho Evra® birth control patch to carry a new bolded warning that stated the drug exposed women to 60 percent more estrogen than the traditional birth control pill. The women in both lawsuits used the Ortho Evra® patch before the warning went into effect.

The plaintiff's attorneys are carrying the largest caseload in the country against Ortho Evra®, representing more than 450 plaintiffs.
